Terms of Use
These Terms of Service and Privacy Policy (individually and collectively referred to as the “Agreement” and/or “Terms”) are binding and govern the relationship between the User (“You”, “User”) and OPTIVARA LTD, registered address: 41 DEVONSHIRE STREET, GROUND FLOOR, LONDON, UNITED KINGDOM W1G 7AJ (hereinafter referred to as “OPTIVARA”).
Definitions
- “User” — an individual who has registered an account with OPTIVARA and uses or plans to use OPTIVARA’s services.
- “OPTIVARA Virtual Number” — a phone number intended solely for receiving SMS.
- “eSIM” — an embedded programmable SIM module (eUICC) required for using OPTIVARA’s services.
- “OPTIVARA Products” — eSIM and other services and products offered by OPTIVARA.
- “Intellectual Property Rights” — all types of rights, including copyrights, trademarks, patents, know-how, and other rights existing or arising in the future.
- “Data” — the volume of mobile internet provided under the selected plan.
- “Data Plan” — a data package with a specific volume, validity period, and cost.
- “Partner Operator” — a telecommunications operator on whose network the OPTIVARA eSIM operates.
- “OPTIVARA Services” — data plans and other services provided by OPTIVARA.
- “Top-Up” — purchase of data plans or services through OPTIVARA’s platform.
General Provisions
These Terms govern the use of all OPTIVARA products and services.
OPTIVARA and the User are independent parties. This Agreement does not create a partnership, employment, or agency relationship.
OPTIVARA adheres to a zero-tolerance policy regarding intellectual property rights violations.
OPTIVARA has the right to amend these Terms at any time without prior notice.
If you do not agree with the Terms — stop using OPTIVARA’s services.
Continued use constitutes full acceptance of the Terms, including the refund terms.
Technical Requirements
- The device must support eSIM.
- eSIM is intended for data transmission only (internet). Calls and SMS are not available.
- The device must be unlocked and support APN settings.
Use of the Service
- To use the service, you must create an account and provide accurate information.
- The User is solely responsible for their use of the service.
- Services are available only to individuals over 18 years of age.
- OPTIVARA may request documents to verify identity.
- The User is responsible for maintaining account security.
- All actions performed through the account are deemed actions of the User.
- The User may delete their account by contacting support.
Refunds
- Refund requests may be made within 30 days after purchase.
- Used services are non-refundable.
- Requests must be submitted only through the support form on OPTIVARA’s platform.
- Review period — up to 15 business days.
- Amounts up to 10 EUR are refunded in YCOINS.
YCOINS
- YCOINS is OPTIVARA’s loyalty program.
- Can only be used within OPTIVARA’s platform.
- YCOINS are not exchangeable for cash.
- Validity period — 1 year.
- Upon first use of bonus YCOINS, a verification charge of 0.50 EUR may be applied.
User Obligations
The User agrees to:
- comply with applicable laws;
- not infringe intellectual property rights;
- not use the service for fraud, spam, or illegal activities;
- not attempt to hack or modify OPTIVARA’s platform.
Liability and Suspension
OPTIVARA may:
- restrict or suspend an account;
- terminate service provision;
- void any balance if fraud is suspected.
An account may be closed if:
- the Terms are violated;
- false information is provided;
- fees are unpaid.
No Warranties
- Services are provided “as is”.
- OPTIVARA does not guarantee uninterrupted operation or data accuracy.
- Services are not intended for use in critical systems (medicine, aviation, etc.).
Limitation of Liability
OPTIVARA is not liable for:
- indirect damages;
- data loss;
- inability to use the service;
- network quality of partner operators.
Maximum liability is limited to the amount of payments made in the last 3 months.
Changes in Legislation
OPTIVARA may amend the Terms in accordance with legal requirements.
The invalidity of any individual provision shall not affect the remaining provisions.
User Consent
By creating an account, the User consents to the processing of their personal data.
If you do not agree — do not use the service.
The User may request account deletion.
Force Majeure
OPTIVARA shall not be liable for failure to perform obligations in the event of:
- natural disasters;
- wars, strikes;
- actions of governmental authorities;
- other circumstances beyond the company’s control.
